These general conditions of sale are concluded on the one hand by the company WVINE, SAS with a share capital of 10,000 euros whose head office is located at 4B rue des verottes, 21200 Beaune, registered in the Dijon trade and companies register. under the number SIREN B 901 936 096 hereinafter referred to as "Wvine" and on the other hand, by any natural or legal person wishing to make a purchase via the WVINE website referred to hereinafter as "the Customer."

Object of the contract

The purpose of these general conditions of sale is to establish the contractual provisions between Wvine and the Customer and the conditions applicable to any purchase made through the w-vine.com merchant site, for the consumer. The acquisition of a good or a service through this site implies unreserved acceptance by the customer of these conditions of sale.

Legal information

Ordinance No. 59-107 of January 7, 1959 and Law No. 74-631 of July 5, 1974 prohibit the sale and offer of alcoholic beverages to minors and the like. Therefore, by completing your Purchase Order, you acknowledge that you have the legal capacity to enter into this contract.

WVINE collects personal data concerning the purchaser as well as, where applicable, that of the recipient of the Order, all the data collected is necessary for processing your order and is intended for WVINE Services. Prices

The prices appearing in the catalog are prices including all taxes in euros taking into account the VAT applicable on the day of the order; any change in the rate may be reflected in the price of the items. Wvine reserves the right to modify its prices at any time, it being understood that the price appearing in the catalog on the day of the order will be the only one applicable to the Customer. Prices shown do not include order processing fees.

Shipping costs, customs taxes and formalities are the sole responsibility of customers.

Orders

The customer places an order on the “www.w-vine.com” website. To purchase one or more items, they must follow the following ordering process:

  • Choice of items and addition to basket
  • Validation of the contents of the basket
  • Identification on the website and registration on the identification form on which he will indicate all the requested contact details
  • Choice of payment method and acceptance of the GTC
  • Payment validation

The customer will receive an order confirmation email. The customer can at any time view during the ordering process the details of his order as well as its total price and correct any errors, before confirming it to express his acceptance. Wvine retains ownership of the items until full payment of the order, that is to say, receipt of the price of the order by WVINE. Wvine reserves the right to cancel or refuse any order from a Customer with whom there is a dispute over payment for a previous order or a customer who does not have the capacity to contract. Any order implies acceptance of the prices and descriptions of the items available for sale. Wvine undertakes to honor orders received on the website only within the limits of available stocks.

Order control

Given the resurgence of frauds listed in the context of online commerce and in order to secure payments, for any order placed by a customer on the w-vine.com site, WVINE will check the elements of the order before delivery. .

Pursuant to Article L 3342-1 of the Public Health Code, prohibiting the sale of alcohol to minors under the age of eighteen (18), the customer agrees by validating his order to be over 18 years of age. . WVINE reserves the right to ask the customer for a copy of a valid identification document which will confirm the majority of the customer. In cases where WVINE will make this request to the customer, failure to present a valid identity document will result in the cancellation of the order by WVINE. The company WVINE reserves the right not to accept for a legitimate reason a ordered. This legitimate reason may correspond to a suspicion of fraud linked to the abnormality of the order. Any order will in any case be honored within the limits of available stocks.

Shipping and delivery times

Any order placed and paid for on the Wvine site from Monday to Friday (excluding weekends and holidays) will be prepared and shipped within 2-3 days, subject to payment validation.

Wvine undertakes to ship orders placed by the Customer on time. If the said items have not been shipped within 7 days from the date of shipment provided for when ordering, and if this overrun is not related to a case of force majeure, the Customer may proceed to the resolution of the sale, by sending by registered mail with acknowledgment of receipt to the following address: WVINE - 4B rue des verottes 21200 Beaune. The sums paid by the Customer will then be fully refunded.

The indicative delivery time for customers is as follows:

  • France: 1 to 2 working days
  • European Union: 2 to 7 working days
  • Others: 5 to 20 working days

The customer has 30 working days from the date of dispatch of the order to report the non-receipt and request the resolution of the sale and the refund of the items. After this period, no resolution of the sale will be accepted. The customer is required to check the condition of the items delivered. Any anomaly noted (missing item, damaged package, broken item, etc.) must be indicated to Wvine within 3 days of receipt.

Circumstances beyond our control

We cannot be held responsible for any loss, damage, error or failure to deliver a shipment once it is established that circumstances exist beyond our control.

By "circumstances beyond our control", we mean in particular:

  • fortuitous or force majeure events, namely in particular: earthquakes, cyclones, storms, floods, wars, road, train and plane accidents, embargoes, etc.
  • any defects or peculiarities related to the nature of the shipment even if it would have been known to us at the time of our acceptance
  • any act, deficiency or negligence of any third party, for example: the recipient, any interested third party, any customs employee or any other administration employee, the postal services, any carrier or other third party to whom the shipment would be entrusted by our service provider transport, to serve sectors not directly served by itself, even though the shipper has not requested or been informed of the use of a third party.

Indirect damage

In the event of non-compliance with our commitments and whatever the cause, WVINE will only be liable for the reimbursement of the delivery service subject to the reservations set out above (Delay in Delivery) and in no case for damage. indirect that the client would come to invoke. These indirect damages and losses are understood in particular by any loss of income, profits, interest or markets and any loss linked to the inability to use all or part of the shipment.

Breakage during shipment

If a package arrives at the recipient damaged (breakage of the bottle (s)), the recipient must refuse the package. The carrier will take care of informing WVINE. Upon receipt of this information, WVINE undertakes to immediately forward to the recipient an identical package subject to available stock. Under no circumstances may the customer demand reimbursement of the product and the delivery package unless the item (s) are no longer in stock.

Withdrawal period: exchange or return

Customers, non-professional individuals, benefit from a withdrawal period of fourteen days from the delivery of their order to return the product to Wvine for exchange or reimbursement without penalty, and without return costs. Return costs are offered by Wvine. The Customer will be refunded in full as soon as possible and no later than 14 days after the date on which he exercised his right of withdrawal.

Conditions of exchange and return for refund

Returned items must be intact, unopened and in pristine condition. They must be returned in a condition allowing their re-marketing.

The Customer must make his return via Chronopost.

If the Customer were to return the articles by another method of return, and bearing as such return costs, he could not claim any refund or exchange from Wvine.

The customer must keep proof of the parcel's deposit with the service provider responsible for the return. In the absence of this proof, no exchange or refund can be made in the event of loss of the package.

If a package and its container are returned by the carrier to Wvine due to the carrier's inability to deliver for the following reasons

  • Impossibility of the carrier or the seller to contact the customer in order to execute the delivery within one month
  • Parcel left in a relay point for more than a month and not collected by the customer
  • Non-payment of customs fees by the customer

The parcel and its container will be automatically returned by the carrier to Wvine who will keep and reserve this bottle for another 1 month to the buyer who will have the possibility to have his order delivered again under the conditions of payment of the new transport costs and also of the return and customs costs previously generated and paid by Wvine.

If the period of one month after the return of the package and its container is exceeded, the contents will again become the property of Wvine and the customer will not be entitled to a refund. As the customer does not know the storage conditions of the bottles during the delivery period, the bottles will be considered by Wvine as unmarketable.

Responsibility

Wvine cannot be held liable in the event of non-performance of the contract, in the event of a stock shortage or unavailability of the product, force majeure and, in particular in the event of a total or partial strike, flood, fire or other natural disasters. and generally all events that do not allow the proper execution of the order.

Electronic signature

The "OK" associated with the authentication and non-repudiation procedure and the protection of all messages constitutes an electronic signature. This electronic signature has the value, between the parties, of a handwritten signature.

Evidence

The computerized registers, kept in Wvine's computer systems under reasonable security conditions, will be considered as proof of communications, orders and payments between the parties.

Amicable settlement of disputes

These general conditions of sale above are governed by French law. In the event of difficulties in the application of these general conditions of sale, we invite you to seek an amicable solution by contacting our Customer Service in advance. If you are not satisfied with the response provided by Customer Service, you can use the mediation service for consumer disputes by sending your complaint by email to our appointed mediator: Mr. Maxim Scatamacchia, at contact@w-vine.com

Otherwise, the French courts will be competent.

Respect for confidentiality

The customer, product buyer on the www.w-vine.com website undertakes not to communicate the bottle tracking information to the winery that produced and sold the wine. This includes batch numbers, serial numbers, tracking, NFC chip, QR code, etc. This is in order to respect the confidentiality and respect of the personal data of the people who bought/sold the wine, in accordance with the RGPD (Regulation (EU ) 2016/679 of the European Parliament and of the Council of 27 April 2016, on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/ CE) Failure to comply with this rule may be the subject of legal proceedings, compensation for the damage and notification to the CNIL in charge of the general regulations on data protection.
